AIRPORT CERTIFICATION PROCEDURES
1.1 The certification of an airport in the Hashemite Kingdom of Jordan is governed by regulation 139 of the Jordan Civil Aviation Regulations, JCAR Part 139, Certification and Operation of Land Airport. The regulation provides that-
1. An application for a certificate to operate an airport in Jordan shall be made to the of the Civil Aviation Regulatory Commission.
2. On receipt of an application, the Chief Commissioner may:-
(a)direct the applicant to furnish any additional information that he may require;
(b) where he is satisfied, having regard to-
- the applicant’s previous conduct and experience;
- his equipment, organization and staffing
- the arrangement that he proposes to make to ensure that the airport and its aerodrome traffic zone are properly maintained and safe for use by aircraft; and
- the physical characteristics of the aerodrome and its surroundings;
- That the applicant is competent and the airport is safe for use by aircraft, grant the certificate subject to such conditions as he thinks fit to impose.
3.An airport operating certificate under this regulation shall remain in force for the period specified in the certificate and may be renewed for such further period as the Chief Commissioner thinks fit.
4.The Chief Commissioner may, under this regulation issue a certificate for public use in respect of any airport.
5. Where a certificate for public use is issued under this regulation in respect for an airport, the airport shall be made available, at all times when it is available for take off and landing of aircraft, to all users on equal terms and conditions.
6. No person shall operate an airport open for public use in Jordan unless –
(a) he holds a certificate to that effect; and
(b) he operates the airport in accordance with terms and conditions of the Airport Operating Certificate.
1.2 An airport operator who does not, under paragraph 1.1(6), hold an Airport Operating Certificate may apply for an airport operating certificate under procedures prescribed in this publication.
1.3 The procedures adopted by the Civil Aviation Regulatory Commission (CARC) for issuance of an Airport Operating Certificate shall normally take the following sequence:
(a) Dealing with the expression of intent by an intending applicant for an Airport Operating Certificate;
(b) Application by the applicant;
(c) Assessment of application by the CARC ;
(d) Inspection of airport by the CARC; and
(e) Grant of the Airport Operating Certificate;and
(f) Promulgating the certified status of an airport and the required details in the AIP.
2) DEALING WITH THE EXPRESSION OF INTENT
2.1 Upon receipt by the CARC of the expression of intent to certify an airport, the CARC will conduct a flight operation assessment to ensure that the operation of an airport at the specified location will not endanger the safety of aircraft operations.
2.2 The flight operations assessment should take into consideration the proximity of the airport to other airports and landing sites, including military airports; obstacles and terrain; any excessive operational restriction requirements; any existing restrictions and controlled airspace; and any existing instrument procedures.
2.3 Should the result of the above assessment be positive, the CARC should advise the applicant to submit a formal application for an Airport Operating Certificate in accordance with JCAR Part 139, requirements.
3) APPLICATION FOR AN AIRPORT OPERATING CERTIFICATE:
3.1 The application for the grant of an Airport Operating Certificate must be made in writing on CARC form DASS-1, shown in appendix 1of this publication, to the CARC by the prospective airport operator. The application shall be submitted along with: –
(a) Two copies of the Airport Certification Manual , prepared in accordance with the requirements of JCAR part 139;
(b) A plan of the airport and its facilities (preferably on a scale of 1:10,000);and
(c) Evidence of lawful entitlement to use the land and operate the airport and a third party insurance policy acceptable by the CARC Chief Commissioner.
3.2 The applicant shall pay the applicable fees and charges prescribed by the under the related regulations.
3.3 The applicant should submit the application well in sufficient time to allow the CARC for detailed consideration and facilities inspection before issuance of the certificate. The minimum time required is 90 days from the date of submission of the application.
3.4 The applicant should either be the owner of the airport or have obtained the legal authorization to manage and use the airport for use as an airport.
3.5 A prospective applicant, applying for an Airport Operating Certificate, should provide the CARC with full information of facilities, technical data and operational procedures concerning the requirement of the certificate. This will enable the CARC to facilitate application processing.
3.6 The applicant shall maintain close coordination with CARC and shall inform the CARC of any significant changes in their operational activities, staff management, or airport data during the certification process.
3.7 The submission of the formal application by the applicant shall be interpreted to mean that the applicant is aware of the specific requirements, regulations, and rules applicable for the management and operation of the proposed airport and that he is prepared to show all documents and his methods of compliance.
3.8 The airport certification application forms can be obtained from the Civil Aviation Regulatory commission or the CARC website.
4) ASSESSMENT OF APPLICATION:
4.1 On receipt of the application in line with paragraph 3 above, the CARC may –
(a) direct the applicant to furnish any additional information that it may require; and
(b) conduct inspection of the facilities, equipment and operating procedures to ensure that the proposed airport shall be safe for use of aircraft operations; or
(c) Where the CARC is fully satisfied that the applicant is eligible for obtaining the Airport Operating Certificate, the CARC shall issue the certificate as per paragraph 6.
4.2 The CARC needs to be satisfied that the applicant is able to ensure an effective airport management and the activities which are related to the safe operations of the aerodrome such as:
(a) a level of service that meets the certification requirements;
(b) the potential ability to maintain, test and execute the emergency procedures;
(c) operating minima associated with the particular certified airport;
(d) suitable personnel, equipment, facilities, manuals, buildings and service agreements etc or that the airport operator will be able to obtain or maintain them; and
(e) Sufficient financial resources.
4.3 In those cases where an applicant’s organization is in the formative stage and has little or no airport management experience, the applicant shall be advised that it may be required to submit more details to judge his ability and competence, and that the overall period required to reach a final decision on this application may be protracted.
5) AIRPORT INSPECTIONS AND AUDITS:
5.1 Before a certificate is granted, the airport operator is required under the airport certification regulations to permit the CARC or its authorized representative(s) to carry out inspections and audits of the operator’s airport, documents and records to enable the CARC to be satisfied that –
(a) the physical conditions on the maneuvering area, apron and in the environs of the airport are acceptable and safe;
(b) the equipment and facilities provided are adequate for the safe flying activities which are expected to take place and that the required maintenance programmes are established; and
(c) the applicant for the certificate is able to ensure an effective airport management organization and, in those activities which are related to the safe operations of the airport, the provision of staff who are competent and where necessary suitably qualified.
5.2 During the certification process, the applicant shall satisfy the CARC of his eligibility for the award of an Airport Operating Certification, his ability and competence to conduct safe and efficient management of the airport, and to comply with applicable regulation and rules.
5.3 Following the initial grant of a certificate, periodic inspections/audits of the airport shall be made by the CARC or its authorized representatives to ensure the compliance with certification requirements and the satisfactory maintenance standards of the equipment and facilities at the airport. Normally, prior notice will be given to the holder of the certificate, but inspections may also take place without such prior notice. The holder of the certificate shall co-operate and facilitate the inspections.
5.4 The inspections are an important and integral part of an airport certification program/process and shall be conducted precisely to determine that the applicant for a certificate is able to ensure effective airport management and those activities which are related to the safe operation of the airport, aircraft and staff.
